In a historic decision, the Supreme Court’s five-judge Constitution Bench unanimously struck down the electoral bond scheme, deeming it unconstitutional. Led by Chief Justice of India D.Y. Chandrachud, the court ruled that the scheme violated the right to information enshrined in Article 19(1)(a) of the Constitution. Justice Sanjeev Khanna concurred with the decision.

Additionally, the court invalidated the amendments to the Income Tax Act and the Representation of People Act that facilitated anonymous political contributions. This landmark verdict promises to enhance transparency in political funding and level the playing field for political parties ahead of the upcoming general elections.

Notably, the BJP received a substantial portion of its income through electoral bonds in 2022-23, far exceeding that of its main rival, the Congress party. The court emphasized that anonymous political donations undermine the fundamental right to information, which is essential for upholding participatory democracy and government accountability.

It highlighted the inherent connection between economic inequality, political engagement, and the potential for quid pro quo arrangements resulting from financial contributions to political parties.
